Rights clearance is the fundamental and meticulous legal process of identifying and obtaining permission to use all third-party intellectual property that appears in a film.
Building a Clean ‘Chain of Title’ ⛓️
A motion picture is a complex collage of numerous individual pieces of intellectual property (IP). To be legally distributed, a film must have a clean ‘chain of title,’ which is the documented history that proves the producer has the legal right to every single element seen and heard in the final product. Rights clearance is the practical, hands-on process of building this chain.
Failure to properly clear rights can have catastrophic consequences, including lawsuits that can halt a film’s release, force expensive re-edits, or result in substantial damages. No distributor or broadcaster will touch a film without proof of proper clearance.
The Scope of Clearance
The clearance process must account for a vast range of potential IP. Key categories include:

This process begins in pre-production with a script clearance report and continues meticulously throughout production and post-production, culminating in a ‘clearance binder’ that contains all the necessary licenses and legal paperwork.
