You Can’t Copyright a Life Story 📖

A common misconception is that you need to ‘buy the rights’ to someone’s life to make a film about them. Legally, this is not true. The factual events of a person’s life are in the public domain and cannot be copyrighted. A filmmaker is free to make a biographical film about any public figure without their permission, provided the film is factually accurate and does not defame them.

So why do producers go to great lengths to acquire life rights? The answer is that a life rights agreement isn’t about buying the story itself; it’s about buying two other, far more valuable things: cooperation and legal protection.

The Two Pillars of a Life Rights Deal

1. Exclusive Cooperation: The subject of the film agrees to cooperate exclusively with the producer. This can include granting personal interviews, providing access to private diaries and photographs, and facilitating introductions to family and friends. This exclusive access provides the filmmakers with authentic, intimate details that cannot be found in public records, adding immense value and depth to the project.
2. Waiver of Claims: This is the most critical element from a legal perspective. As part of the agreement, the individual signs a release, contractually waiving their right to sue the production for potential legal claims such as defamation, invasion of privacy, and infringement of the right of publicity.

This waiver is a powerful legal shield. For any film about a living person, securing a life rights agreement is almost always a non-negotiable requirement to obtain the Errors & Omissions (E&O) insurance necessary for distribution. Without it, the risk of a lawsuit is considered too high for an insurer to take on, rendering the film undistributable.
