A provisional certificate is an official but temporary document used in various administrative and legal aspects of film production. It serves as a placeholder, allowing a production to move forward while awaiting the finalization of a more comprehensive or permanent certification. Its function is to satisfy an immediate contractual or regulatory requirement, with the understanding that it will be superseded by a final document once all conditions have been fully met.
This concept is most frequently encountered in two key areas: government film incentives and certifications of origin.

Film Tax Credits and Incentives: Many countries and states offer lucrative tax rebates or credits to productions that film in their jurisdiction. To qualify, a production must meet specific criteria, such as spending a certain amount of money locally or hiring a certain percentage of local crew. A production company can often apply for a provisional certificate of eligibility at the beginning of the project. This certificate, issued by the government film office, confirms that the project’s plan appears to meet the requirements. It is not a guarantee of payment, but it is often required by financiers and banks to secure loans against the future tax credit. The final certificate, which authorizes the actual payment, is only issued after production is complete and all spending has been audited.

Co-Production Treaties: For international co-productions seeking to qualify under a treaty between two or more countries, a provisional certificate is often the first step. The certificate confirms that the project, as planned, meets the treaty’s requirements regarding creative and financial contributions from each country. This provisional status allows the producers to access the benefits of the co-production treaty (such as being considered a ‘national’ film in each country) during the production phase. The final certificate of origin is granted only after the film is finished and all contributions have been verified.
In both cases, the provisional certificate is a vital tool for unlocking financing and enabling production to begin. It provides a level of official assurance to stakeholders that the project is on track to meet its legal and financial obligations, even before the final paperwork can be completed.
