Location Release Form

A location release form is a legal contract signed by a property owner that grants a film production permission to shoot on their property.

A location release form is one of the most essential legal documents in film production. It is a binding contract between the production company and the owner of a private property (a house, a business, a vacant lot, etc.) that grants the production the right to film on that property. This form is a critical part of the production’s legal paperwork, known as the ‘chain of title.’ It is absolutely required by distributors, broadcasters, and the production’s Errors and Omissions (E&O) insurance provider.

Without a properly executed location release, the footage shot on that property is legally vulnerable. The property owner could potentially sue the production for trespass or invasion of privacy, or even seek an injunction to prevent the film’s release.

Core Provisions of the Release

A standard location release form contains several key clauses that protect the production company:

  • Grant of Rights: The property owner explicitly grants the production company permission to enter their property with cast, crew, and equipment for the purpose of filming.
  • Right to Depict: The owner grants the right for the property’s likeness, both interior and exterior, to be photographed and included in the film. This right usually extends to worldwide distribution in perpetuity, across all media.
  • Right to Fictionalize: This crucial clause allows the production to portray the location in any way they see fit for the story. This protects them if, for example, a family home is depicted as the site of a fictional crime or other unsavory events.
  • Compensation: The form details the agreed-upon location fee to be paid to the property owner.
  • Release of Claims: The property owner formally releases the production from any future legal claims related to the use and depiction of their property in the film.
