2. The nature of the copyrighted work. (Was the original work highly creative or more factual?)
3. The amount and substantiality of the portion used. (Was only the necessary amount used to make the critical point?)
4. The effect of the use upon the potential market for the original work. (Does the new use substitute for or harm the market for the original?)

The lawyer’s formal letter details this four-factor analysis for each clip and concludes with their professional legal opinion that the uses are defensible under the doctrine. This letter provides the insurer with the confidence to issue a policy, thereby allowing the documentary to be distributed.
