The Agent’s Commission
A booking fee, more commonly known as an agent’s commission, is the primary means by which a talent agent is compensated for their work. It is a percentage of a client’s gross earnings from an entertainment-related job that the agent has procured for them. The agent’s role is to find audition opportunities, negotiate contracts, and manage the deal-making process. The booking fee is their payment for these services.
The 10 Percent Standard
In the American film and television industry, the standard agent’s commission is 10%. This rate is heavily regulated and codified in franchise agreements with the major performers’ unions, most notably SAG-AFTRA. This cap prevents agents from charging exorbitant fees and protects the artists they represent. The commission is calculated based on the actor’s gross earnings for the project, which includes their initial salary, overtime, and any subsequent payments like residuals.
The Flow of Payment
The payment process is standardized to ensure the agent receives their fee. When an actor works on a union production, the production company’s payroll department is typically instructed to send the actor’s paycheck directly to the talent agency. The agency’s accounting department then deposits the check, deducts the 10% commission, and issues a new check to the actor for the remaining 90%. This process streamlines payment and ensures the commission is paid before the money reaches the actor.
It is crucial to distinguish this from a manager’s commission. A talent manager, who provides career guidance rather than procuring employment, typically charges a 15% commission. For an actor with both an agent and a manager, this means a total of 25% of their earnings will go towards their representation team.
